In 1972, Mrs. Suharti and her husband, Syahlan P. Harjono, founded the restaurant “NY. SUHARTI” in Yogyakarta. Seeing the interest and greater potential of this culinary industry, Mrs. Suharti and her husband agreed to expand “NY. SUHARTI” to various cities in Indonesia in 1984. Unfortunately, this married couple had to divorce, and the husband’s name was recorded as the official proprietor of “NY. SUHARTI,” taking the business away from Mrs. Suharti.
Mrs. Suharti is not a regular culinary practitioner. She is a relative of Mbok Berek, another Fried Chicken legendary from Sleman, Yogyakarta. Young Suharti was a chef in the kitchen of a Mbok Berek restaurant. She was trusted to build a Mbok Berek branch, until she split ways with her spouse by presenting her own brand.
Mrs. Suharti, the owner of the original name and recipe for this fried chicken, did not give up and rebuilt his business by providing Ayam Goreng Suharti, without “NY.” The logo is unique, since it includes her photograph.
Ayam Goreng Suharti has regained its leading position as a result of his experience and hard work. At that point, many are unsure which Suharti is the genuine one.
Both Brands Legality
In terms of the legitimacy of their business entities, both have an established legal basis. However, under the first to file principle of Intellectual Property, Ayam Goreng Suharti has previously registered its trademark with the DJKI (“Directorate General of Intellectual Property“).
Meanwhile, “NY. SUHARTI,” which is recognized original and has existed for a longer period of time, just registered its trademark in 2021. In compliance with Law Number 20 of 2016 on Trademarks and Geographical Indications, there is a chance that the brand “NY. SUHARTI” will be rejected when it is initially registered since it is similar to existing brand names in the same class. However, “NY. SUHARTI” may reapply and get approval since it is depending on the examiner’s decision based on documents and historical facts.
