Indonesia Will Revise The Copyright Law

Yuslisar Ningsih, the Director for Copyright of Ministry of Justice and Human Rights of Indonesia, said, the Copyright protection in Indonesia would be revised to be 70 (seventy) years after the creator died. Currently, the draft of Amendment of the Copyright Law is still discussed in the Parliement of Indonesia.

According to article 29 (1) of Copyright Law No 19 of 2002, the protection of Copyright in Indonesia shall be valid for the life of the Author and 50 (fifty) years after his death. With this amendment, the protection of Copyright in Indonesia will be extended for 20 year longer.

Yuslisar said, the amendment of Copyright Law in Indonesia would be adapted from Trade Related Aspect of Intellectual Property Rights (TRIP’s) Agreement. So, the Copyright protection in Indonesia will consistent with the Copyright Law in the United States and Europe.

The protection of original VCD, DVD and software in Indonesia will be stronger with this amendement. It will give the maximum protection for the creators for enjoying his economic rights, and will reduce VCD, DVD and software piracy in Indonesia.

According to article 30 (1) of Copyright Law No 19 of 2002, the protection of Copyright of Software and Cinematographic works shall be valid for 50 (fifty) years as of the first publication.

The Protection of Copyrights of Software and Cinematographic in Indonesia was the most importance, because, according to data from International Data Corporation (IDC) researched on the period of April 2012, Indonesia was ranked 11th most pirated countries in the world. The circulation of pirated software was 86 % with the potential losses reached U.S. $ 1,46 billion or around Rp12,8 trillion. The number was up about 10% from the previous year. Due to the high piracy rate, the commercial value of legal software in Indonesia was only U.S. $ 239 million.

According to Statistical Data from Directorate General of Intellectual Property Rights of Indonesia, the applications of Copyrights registration for the period of 2013 were 5,542 applications. While, the Copyrights registration for the period of 2012 were 7,021 applications. The Copyright registrations in Indonesia for period of 2012 were increased about 78 % than the period of 2011.

The amendment of Copyright Law In Indonesia is expected to increase the number of applications of Copyright registrations in Indonesia.
